Abstract

The concept of good faith in societies is a purely ethical concept, meaning acting with honesty and sincerity, and adhering to what human moral nature dictates. However, the concept has legal dimensions that are not limited to criminal law, but also extend to other branches of law, including civil, international, and public law. It is the general principle for fulfilling a person's obligations in their daily lives, in addition to being an important and fundamental aspect of human ethical behavior. , as it is used as a basis for the establishment of a person’s criminal and civil liability or not, and one of the foundations upon which criminal justice is based, and upon which the principle of good faith is linked within the scope of the Penal Code to the moral element of the crime, which consists of the two elements of knowledge and will, which constitute the scope of criminal intent. Whoever has good faith has no criminal intent, but whoever intends to intentionally harm others by causing the criminal result resulting from his action, the availability of Criminal intent was present against him, and he deserved the penalty.
